Terms of service
1. General provisions
These terms of sale (the "Terms") set out the rights, obligations and liability of the buyer and Obdera (the "Seller"). By placing an order the buyer confirms having read and accepted the Terms, the Return and refund policy and the Shipping policy.
2. Orders and contract formation
The contract is concluded when the buyer pays for the order and the Seller confirms it by email. The Seller may decline to fulfil an order if the item is no longer available in stock or from the supplier - in that case the amount paid is refunded within 5 business days.
3. Prices, payment and obvious pricing errors
Prices are in euros including VAT. Due to technical or human error a price may be displayed obviously incorrectly (for example EUR 54 instead of EUR 5,400). In such cases the Seller may cancel the order, informing the buyer without delay and refunding the amount paid. An obviously erroneous price does not oblige the Seller to sell at that price.
4. Delivery and passing of risk
Delivery terms are set out in the Shipping policy. Risk of accidental loss or damage passes to the buyer upon delivery. The buyer must inspect the package on receipt and report damage immediately.
5. Returns
The return procedure, the list of non-returnable items and the conditions are set out in the Return and refund policy, which forms an integral part of these Terms.
6. Warranty
The Seller provides no additional commercial warranty and performs no servicing. All goods carry the manufacturer's warranty, executed by the manufacturer or its authorised service network - warranty claims are handled per the manufacturer's procedure, with the Seller assisting in filing. Consumers retain statutory rights regarding product conformity under the Lithuanian Civil Code, which these Terms do not limit.
7. Limitation of liability
Diagnostic equipment is intended for use per the manufacturer's instructions by persons with appropriate knowledge. The buyer is solely responsible for coding, programming, adaptations or other actions performed on vehicle control units using the purchased equipment. The Seller is not liable for: indirect losses and lost profit; vehicle faults arising from use of the equipment; incompatibility with a specific vehicle where the buyer failed to verify compatibility before purchase; the operation of and changes to manufacturer software, licences or accounts. Any liability of the Seller is limited to the price paid for the item, to the extent permitted by mandatory law.
8. Force majeure
The parties are released from liability for non-performance caused by force majeure circumstances under the laws of the Republic of Lithuania.
9. Personal data
Personal data is processed for order fulfilment under the GDPR and Lithuanian law. See the Privacy policy.
10. Business customers (B2B) and high-value equipment
For purchases in a company's name: the 14-day withdrawal right does not apply and goods are not taken back due to a change of mind - all B2B sales are final; only the manufacturer's warranty applies; the Seller's liability is limited to the maximum extent permitted by law.
Equipment priced over EUR 2,000 is sold exclusively to business customers (companies or self-employed persons with a business registration). By ordering such equipment the buyer confirms that the purchase is made for business purposes; the Seller may request company details before fulfilling the order and may cancel orders that do not meet this condition, refunding the amount paid.
11. Final provisions
The Terms are governed by the law of the Republic of Lithuania. Disputes are resolved by negotiation, failing which per Lithuanian law. Consumer disputes are handled out of court by the State Consumer Rights Protection Authority (www.vvtat.lt); the EU ODR platform at ec.europa.eu/odr may also be used. The Seller may amend the Terms at any time - the version in force at the time of ordering applies.
